Abstract

The right to defense, as a component institution, inseparable part and principle of Due Process, reaches an important place in the field of Criminal Procedure Law. The present work has as objective a study of this principle and its current regulation in the Cuban penal norm, from the perspective of the main existing theories on this principle, of the historical and legislative antecedents on this right, as well as an analysis compared with other procedural laws in force, on the treatment offered to this principle. The institution of the right to defense is identified in the regulations of the Cuban criminal process collected in the current Law 143/21 of the Criminal Process of Cuba, and as a result of this investigation the correlation of the theoretical/doctrinal foundation of the Right to Defense was demonstrated as a fundamental principle of Due Process, in the regulation of the new Cuban criminal process.
