The Family Caregiver. A Pending Issue for Labor Law and Social Security

Abstract

In Cuba the existence of the family caregiver has achieved a strong boom because due to the longevity of the population there are several family members who have assumed this noble task that results in the protection of another family member. The current Constitution of 2019 pronounces on the due protection and care that family members must provide to their older adults, as well as the duty of the State to guarantee them the means and ways for them to live with dignity. Similarly, the Family Code Project recognizes the due safeguarding of the rights of grandmothers and grandfathers and the obligation of children to their parents as the institution of the family caregiver in its articles 409 to 416. However, both the Constitution as well as the new regulations resulting from it impose challenges for different disciplines of the legal sector. The Labor and Social Security Law does not escape this rule, which must assume a differentiated, specialized treatment for those workers who find themselves in this situation of family caregivers.
