Freedom of the Press, Presumption of Innocence and the Limits of the Media in Judicial Matters

Abstract

We are in the digital age and users have found a way to be connected and updated with the news that interests them or simply through social networks and other traditional media participate in the entertainment they offer; also managing to learn of raucous and presumably criminal facts that on many occasions are presented without evidence and lacking legal evaluations. This paper aims to analyze the problem that arises for criminal justice when mass media violate principles such as the presumption of innocence and the limits of freedom of the press are exceeded, concluding our observations with some proposals to achieve weighting and harmony that is necessary to observe in the face of this widespread social problem in avoidance of the affectations that occur to the identity and personality of the subjects involved in criminal acts.
