The Transnational Effectiveness of Law in the Face of the New Scenarios of International Migration and Private International Law in Cuba

Abstract

A new approach towards migration with a transnational incidence burst into a significant way upon private international Law.   The location of the immigrant in a double relation scenery and interaction towards both sides, origin and destiny, multiform, prolonged and interactive, will he generating a volume of relationships with elements of internatinationality which grows and gets complex. Such relationships face a judicial diversity when generate a coosing or interaction of legislations and judicial systems. That is why a transnational approximation pretends to avoid isolation of every judicial order and favor a process of progressive normative convergence which allows leading the relations that surpass frontiers, which lead towards integrations models of this normative diversity, able to achieve the inclusion of all the individuals in stable and legitimate judicial orders.
