The Protection of People in Vulnerable Situations beyond the Family Code: Legal-Criminal Protection

Abstract

The family is the fundamental nucleus of society, the oldest social institution and the only vital natural grouping. Among its members, it is made up of people most exposed to the violation of the full exercise of their rights and fundamental freedoms due to their personal characteristics, such as age, sex, marital status, ethnic origin, state of dependency or situation of disability, who in turn represent to the most disadvantaged and weak sectors of society. The phenomenon of discrimination and violence manifests itself more frequently in this area, its main victims being boys, girls and young people, women, the elderly, people with disabilities and those who are excluded due to their sexual orientation. That is why the Cuban State recognizes the need to protect them, seeks their integration, well-being and social, cultural and economic development through its regulation in the Family Code and in the Penal Code, in the latter, given the way in which it makes visible treatment of issues such as intrafamily violence associated with family relationships.
